01 Acceptance of these terms

These Terms and Conditions (“Terms”) govern your use of the Cumberland Cannabis Company website and related online services. By using the website, contacting us through it or placing an order through a linked ordering service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the website or its services. In these Terms, “Cumberland Cannabis,” “we,” “us” and “our” mean Cumberland Cannabis Company.

02 Age and legal eligibility

The website concerns non-medical cannabis and is intended only for people who are at least 19 years old. You must satisfy all legal age, identification and eligibility requirements that apply in British Columbia.

Access to the website or acceptance of an online order does not remove our right or duty to verify identification. We may refuse entry, service or release of an order when age or identity cannot be verified or when completing the transaction would violate applicable law.

03 Online menu and pickup orders

Our online menu and ordering functions may be operated by a third-party service. Its own terms and privacy policy may also apply. An order submission is a request to purchase, not a guarantee that a product is available or that the order has been accepted.

We may confirm, decline, limit or cancel an order because of inventory changes, pricing errors, legal limits, suspected misuse, inability to verify age, technical problems or other reasonable operational concerns. If payment was collected for an order we cannot fulfill, the applicable refund will be handled using the original payment method or platform process.

Estimated preparation times, including a typical 15-minute pickup time, are estimates only. Orders may take longer during busy periods. Products must be picked up during applicable shop hours and in accordance with identification requirements.

04 Products, prices and availability

Product availability, potency, package size, descriptions, images, prices, taxes and promotions may change without notice. We try to keep information accurate but do not guarantee that every website or menu detail is complete, current or error-free.

The legally required product label and sealed retail package take precedence over website descriptions or images. Purchase and possession limits imposed by law apply to every transaction. Promotions cannot be combined unless expressly stated.

05 Acceptable use

You agree not to misuse the website or attempt to interfere with its operation. You must not:

• use the website or services for an unlawful, fraudulent or unauthorized purpose;
• provide false age, identity, contact or order information;
• attempt to purchase cannabis for a minor or another legally ineligible person;
• circumvent age gates, security features or purchase limits;
• introduce malicious code, scrape the website without permission or disrupt its availability;
• impersonate another person or infringe another person’s rights; or
• copy or commercially exploit website content except where permitted by law.

We may suspend access, refuse service or take other lawful action where we reasonably believe these Terms have been breached.

06 Intellectual property

The website’s branding, logos, original text, graphics, layouts, photographs and other content are owned by Cumberland Cannabis Company or used with permission and are protected by applicable intellectual-property laws.

You may view the website and make a temporary personal copy for lawful, non-commercial use. No ownership rights are transferred to you. Third-party names and marks remain the property of their respective owners.

07 Information is not medical advice

Website content and staff-provided product information are general information only. They are not medical advice, diagnosis or treatment and should not replace advice from a qualified healthcare professional. Cannabis affects people differently and may interact with health conditions or medications.

Do not drive or operate machinery while impaired. Use and store cannabis responsibly, follow the product label and keep all cannabis products away from children and animals.

08 Third-party services and links

The website may contain links to maps, social networks, online ordering platforms and other third-party services. These services are operated independently. We do not control and are not responsible for their content, availability, security, privacy practices or terms. A link does not necessarily mean we endorse every statement or service on the linked website.

09 Disclaimers and liability

The website is provided on an “as available” basis. To the extent permitted by law, we do not guarantee uninterrupted access, error-free operation or that all information will always be current.

To the extent permitted by law, Cumberland Cannabis Company and its owners, employees and service providers will not be liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, the website or a third-party service.

Nothing in these Terms excludes or limits a right, remedy, warranty or liability that cannot lawfully be excluded under applicable consumer-protection or other law.

10 Changes, severability and governing law

We may update these Terms when our website, operations or legal obligations change. Updated Terms take effect when posted, with the effective date shown above. Your continued use after an update constitutes acceptance of the revised Terms.

If any provision is found unenforceable, the remaining provisions continue in effect. These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Subject to any mandatory consumer rights, disputes will be brought before the courts of British Columbia.
